Lisbon Court of Appeal rejects request for Competition Authority’s sentence of AIPL to be declared time-barred

The Lisbon Court of Appeal rejected on Friday the request submitted by the Association of Bakery Industries of Lisbon (AIPL) for the case in which it was found guilty by the Competition Authority to be declared time-barred.

The Lisbon Court of Appeal confirmed that the decision became final on 30 November 2012, confirming the sentence of AIPL decided by the Competition Authority in 2008.

The Competition Authority found AIPL guilty of exchanging information on prices with its member companies, with the aim of preventing, distorting or significantly restricting competition, within a large area of the country.

In December 2011, the Lisbon Court of Appeal had already decided to uphold the sentence of AIPL, although reducing the fine applied by the Competition Authority to €850,000, after the Commercial Court of Lisbon had confirmed the decision of the Competition Authority in its entirety in June 2010.
