Competition Authority’s Guidelines on the Adoption of Commitments in Merger Control are presented for public consultation

The Competition Authority is today presenting its draft Guidelines on the Adoption of Commitments in Merger Control for public discussion.

The purpose of the Guidelines is to present a set of suggestions on the selection, design, execution and monitoring of commitments, within the framework of the prior control processes relating to mergers between undertakings. The intention is to contribute to the transparency, efficiency and swiftness of these processes, as well as the strengthening of legal safety.

This public consultation will gather feedback on the content of the Guidelines and other documents that form an integral part of them.

The documentation in question is available at www.concorrencia.pt. It consists of the:

  • Guidelines on the Adoption of Commitments in Merger Control;
  • Draft of the Document of Commitments; 
  • Draft of the mandate to sell;
  • Draft of the mandate to monitor.


Until 15 December 2010, interested parties have the opportunity to forward their observations by e-mail to adc@concorrencia.pt or by fax or the postal service to the following address:
